I. Definitions
Used terms in the regulations mean:
Customer - a natural person, legal person, or an organizational unit that is not a legal person, but to which specific legal regulations grant legal capacity, which places an Order within the Store;
Consumer - a Customer who is a natural person and places an Order not directly related to their economic or professional activity;
Entrepreneur - a Customer who is a natural person, legal person, or an organizational unit without legal personality, conducting business or professional activity on their own behalf, placing an Order related to their economic or professional activity;
Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
Regulations - these regulations for the provision of electronic services within the allegro portal;
Auction Portal (Store) - an internet service available at www.allegro.pl - mbmeganarzedzia, through which a Customer can, in particular, place Orders;
Goods - products presented on the auction portal;
Sales Agreement - an agreement for the sale of Goods within the meaning of the Civil Code, concluded between MB Mega Hurtownia Narzędzia Michał Bogdaniuk mbmeganarzedzia and the Customer, concluded using the auction service.
Consumer Rights Act - the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827); Act on the provision of electronic services - the Act of July 18, 2002, on the provision of electronic services (consolidated text Journal of Laws of 2013, item 1422, as amended);
Personal Data Protection Act - the Act of August 29, 1997, on the protection of personal data (consolidated text Journal of Laws of 2014, item 1182); Order - a declaration of the Customer's will, directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of Goods; MB Mega Hurtownia Narzędzia with its registered office in Biała Podlaska, ul. Sidorska 102, REGON: 361251194, NIP: 4960206286, Seller - MB Mega Hurtownia Narzędzia Michał Bogdaniuk conducting auction sales, hereinafter referred to as mbmeganarzedzia in the further part of the regulations.
II. General Provisions
2.1. The auction portal available at the address www.allegro.pl - mbmeganarzedzia, referred to in the further part of these Regulations as the Auction Portal, is operated by MB Mega Hurtownia Narzędzia Michał Bogdaniuk with its registered office in Biała Podlaska, ul. Sidorska 102, REGON: 361251194, NIP: 4960206286,
2.2. The subject of the portal's activity is sales. All offered products are brand new.
2.3. A detailed list of products along with unit prices can be found on the Auction Portal's website.
2.4. The Sales Agreement is concluded in accordance with Polish law and in the Polish language between the Customer and mbmeganarzedzia.
2.5. All product designations and names are used for identification purposes and may be protected trademarks for which protective rights have been granted to authorized persons.
III. Procedure for the Conclusion of a Sales Agreement
3.1. In order to conclude a Sales Agreement through the portal, you must visit auctions at www.allegro.pl - mbmeganarzedzia, select the product and quantity, and take further technical steps based on the messages displayed to the Customer and the information available on the website.
3.2. The Customer selects the ordered products by adding them to the cart.
3.3. When placing an Order - until the "Order" button is pressed - the Customer has the possibility to modify the entered data and modify the selection of the Goods. To do this, follow the messages displayed to the Customer and the information available on the website. The photos in the auctions may be illustrative photos only, and the products may differ slightly in reality, e.g., in color, packaging, or markings visible in the photos.
3.4. After adding all the necessary data by the Customer using the portal, a summary of the placed Order will be displayed. The summary of the placed Order will include information about: - the subject of the Order, - unit and total prices of ordered products or services, including delivery costs and additional costs (if applicable), - selected payment method, - selected delivery method,
3.5. In order to place the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory, and press the "Order with an obligation to pay" button.
3.6. Sending the Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with mbmeganarzedzia, in accordance with the content of the Regulations.
3.7. The Agreement is considered concluded from the moment the Seller receives the Order placed by the Customer.
3.8. After placing the Order, the Customer will receive an email titled "Confirmation of the conclusion of the contract," containing the final confirmation of all essential elements of the Order, in accordance with Article 21 of the Consumer Rights Act.
3.9. The Sales Agreement is concluded in the Polish language, in accordance with the content of the Regulations.
IV. Prices and Payment Methods
4.1. Prices of Goods are given in Polish zlotys and include all components, including VAT on goods and services at the rate specified by separate regulations;
4.2. The price specified for the Goods is binding at the time of placing the Order by the Customer and will not change until the Order is executed.
4.3. Prices listed in the auction apply only to the auction offer and are valid only within the auction offer.
4.4. In the auction portal, there are the following payment options: - bank transfer to the bank account: mBank 64 1140 2004 0000 3202 7821 0633
- online payment via PayU
- cash payment at the stationary store - applies only to Orders picked up in person at the headquarters of MB Mega.
By using the above-mentioned payment methods, the Customer incurs no additional costs.
4.5. The moment of payment is considered: - in the case of a bank transfer, the moment when the funds are credited to the Seller's account,
V. Order Fulfillment
5.1. Each completed Order is documented by a VAT invoice or receipt, which is sent together with the ordered goods. Each sales document is attached to the shipping list,
As of September 2019, the Act of July 4, 2019, amending the Act on Goods and Services Tax and certain other acts came into force (Journal of Laws No. 1520).
The Act also includes new regulations regarding taxpayers using a cash register, which are intended to prevent abuses in issuing invoices that do not reflect the actual state of affairs - so-called "empty invoices" - to fiscal receipts left by other customers.
The amendment introduces new paragraphs 5-7 in Article 106b into the VAT Act. According to the new provisions, in the case of recorded sales using a cash register confirmed by a fiscal receipt, an invoice for a taxpayer or value-added tax is issued only if the receipt confirming this sale contains a tax identification number (NIP) by which the purchaser of goods or services is identified for tax or value-added tax purposes.
AT THE SAME TIME, WE INFORM YOU THAT WE WILL NOT ISSUE INVOICES FOR RECEIPTS IF THEY HAVE ALREADY BEEN ISSUED FOR A GIVEN ORDER AND DELIVERED TOGETHER WITH THE GOODS. IF YOU WISH TO RECEIVE A VAT INVOICE, YOU SHOULD DO SO IMMEDIATELY WHEN PLACING YOUR ORDER.
5.2. A VAT invoice or receipt is issued after the Customer has settled the entire payment for the Order.
VI. Order Delivery
6.1. The delivery of Goods is limited to the territory of the Republic of Poland and is made to the address provided by the Customer when placing the Order. Shipments are mainly handled by the DPD courier company and Polish Post.
6.2. Delivery of ordered Goods is carried out in the manner chosen by the Customer: - delivery of Goods by a transport company to the address specified in the Order or - personal pickup from the MB Meganarzędzia headquarters
6.3. The delivery time for ordered Goods is from 1 to 21 business days from the date of sending the Order by the Customer. The delivery time is indicated on the card of each product.
6.4. mbmeganarzedzia is not responsible for damages caused by inaccuracies (including errors) made by the Order submitter in the Order Form, as a result of which the shipment did not reach the recipient, as well as for unjustified refusal to accept the shipment.
VII. Order Pickup
7.1. Order pickup must be confirmed in writing on the delivery document.
7.2. A written confirmation of the receipt of the Goods and its release transfers ownership of the Goods to the Customer and all risks associated with possession and use, especially the risk of loss or damage to the Goods.
7.3. During the pickup of the Order, the recipient is obligated to check the delivery for quantity compliance with the Order and to inspect whether the Goods have any mechanical damage that occurred during transport. The entrepreneur is obligated to perform a qualitative and quantitative inspection in the presence of the person delivering the Order.
XI. Personal Data Protection
11.1. When placing an Order, a Customer who is a natural person consents to the processing of their personal data by mbmeganarzedzia, in accordance with applicable regulations, especially the Personal Data Protection Act and the Act on the Provision of Electronic Services.
11.2. The provided personal data are processed by mbmeganarzedzia solely for the purpose of concluding, amending, properly performing, and settling a sales agreement, and performing activities related to its settlement.
11.3. The Seller ensures the exercise of rights arising from the Personal Data Protection Act, in particular, the Customer has the right to access their personal data and the right to change, correct, and request their removal. The right to demand a change, correction, or removal of data provided to the Seller is exercised based on a relevant request sent to the Seller by email, along with the Customer's first and last name.
